Public Notice PUBLISHED IN THE CLAREMORE DAILY PROGRESS, CLAREMORE, OKLAHOMA, OCTOBER 12 & 19, 2016. IN THE DISTRICT COURT IN AND FOR ROGERS COUNTY STATE OF OKLAHOMA AMERICAN SOUTHWEST MORTGAGE CORP., Plaintiff, vs. BENITO M. CASTILLO and KIMBERLY M. CASTILLO, Husband and Wife; et al., Defendants Case No. CJ-2015-440 NOTICE OF SHERIFF'S SALE STATE OF OKLAHOMA TO: BENITO M. CASTILLO and KIMBERLY M. CASTILLO, Husband and Wife; STATE OF OKLAHOMA ex rel. OKLAHOMA TAX COMMISSION; PINNACLE MORTGAGE CORPORATION; SUNTRUST MORTGAGE, INC.; The Unknown Occupants or Tenants of the Subject Property; and to the general public and all interested parties: Notice is hereby given that pursuant to a Special Execution and Order of Sale issued out of the District Court of Rogers County, State of Oklahoma, in an action wherein AMERICAN SOUTHWEST MORTGAGE CORP., was Plaintiff, and BENITO M. CASTILLO and KIMBERLY M. CASTILLO, Husband and Wife, et al., were Defendants, directed to me, the undersigned Sheriff of Rogers County, commanding me to levy upon and sell with appraisement the following described property in Rogers County, State of Oklahoma: Lot One (1) of CAREFREE VALLEY WEST, a Subdivision of Section Eight (8), Township Twenty-one (21) North, Range Seventeen (17) East of the I.B. & M., Rogers County, State of Oklahoma, according to the Seconded Recorded Amended Plat thereof; to satisfy the judgment and decree of mortgage foreclosure in favor of said Plaintiff and against Defendants BENITO M. CASTILLO and KIMBERLY M. CASTILLO, in the amount of $135,696.94, plus accrued interest of $6,615.27 through November 18, 2015, with interest accruing thereafter on the principal balance at the Contract rate of $24.50 per diem from November 18, 2015 until paid; together with the further sum of $2,500.00 in attorney fees, accrued costs of $433.66, costs incurred thereafter, abstract expenses of $985.00, appraisal expense, plus all other costs advanced for preservation and security purposes, property taxes and insurance, if any. I will on the 16th day of November, 2016, at the hour of 10:00 o'clock a.m. of said day, at the Commissioners Meeting Room at the Rogers County District Courthouse, 200 S. Lynn Riggs Blvd., Claremore, OK 74017 offer for sale and sell to the highest bidder for 100% cash at time of sale, the said property above-described, or as much thereof as will satisfy said judgment with interest, costs and attorney's fees, said sale to be subject to all real property taxes owing on said property, if any, and without warranties of title; the appraised value of said real property being the sum of $135,000.00.
