Public Notice PUBLISHED IN THE CLAREMORE DAILY PROGRESS, CLAREMORE, OKLAHOMA, JUNE 29, 2016. TOWN OF VERDIGRIS, OKLAHOMA ORDINANCE NO. 2016-02 AN ORDINANCE AMENDING SECTION 10-303(C) OF THE TOWN CODE OF THE TOWN OF VERDIGRIS, BY AMENDING THE FIREWORKS REGULATIONS OF THE TOWN; PROVIDING A PARTIAL INVALIDITY SAVINGS CLAUSE; REPEALING ORDINANCES OR SECTIONS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING THIS ORDINANCE SHALL BE A PART OF THE TOWN CODE OF ORDINANCES, AS AMENDED, AND; DECLARING AN EMERGENCY. WHEREAS, the Town Board of Trustees of the Town of Verdigris, Oklahoma, deems it in the best interest of the Town to amend the previously adopted ordinance dealing with Fireworks Regulations; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VERDIGRIS, OKLAHOMA: Section 1: Paragraph C of Section 10-303 of the Verdigris Code of Ordinances dealing with Fireworks Regulations is hereby amended to read as follows: C. Except for the days of July 3, July 4, July 5, December 31, January 1 and January 2 of each year, and except as provided in Subsection D. below, it is unlawful to shoot, set off or discharge fireworks within the town. Provided further, however, the Mayor may issue an executive order adding 2 additional days for the Fourth of July holiday, and 2 additional days for the New Years holiday, should the Mayor, in his or her sole judgment, deem such extension reasonable, and such executive order shall be posted at the Town Hall at least 24 hours before such extension becomes effective. Section 2: If any section, subsection or sentence, clause or phrase of this Ordinance is for any reason held invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance. Section 3: Repeal of Conflicting Ordinances. All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby expressly repealed. Section 4: The provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the Town of Verdigris, Oklahoma, as amended. Section 5: Since the immediate operation of the provisions of this Ordinance are necessary for the preservation of public health, welfare and safety, an emergency is declared to exist and this Ordinance shall be in full force and effect from and after its passage by the Board of Trustees.
